Terms & Conditions

These Terms & Conditions (“Agreement”) govern all activities and transactions made through the Casa Khnum website during the Pre-Sale phase. By completing a Pre-Sale purchase, you (“the Client”) acknowledge that you have read, understood, and fully accepted these terms. Casa Khnum reserves the right to update or modify these Terms at any time without prior notice.

1. Nature of the Pre-Sale. The Pre-Sale represents an early purchase opportunity granting the Client priority access to future bookings at Casa Khnum. Payments made during this stage are considered advance reservations or deposits for future use and are not equivalent to immediate room bookings or confirmed stays.

2. Reservation Validity. All Pre-Sale purchases will be redeemable for accommodation starting September 2026, subject to Casa Khnum’s official opening schedule and operational readiness. Each Client will have a period of three (3) years from September 2026 to redeem their reservation, which will remain subject to Casa Khnum’s availability calendar and seasonal demand.

3. Booking Process. Once Casa Khnum begins accepting formal reservations, Pre-Sale participants will receive priority access through an exclusive link or booking code. All reservations must be made via Casa Khnum’s official booking system and confirmed in writing via email. Reservations are confirmed only after receipt of the booking confirmation message from Casa Khnum.

4. Pricing & Currency. All prices are expressed in United States Dollars (USD)unless otherwise stated. Casa Khnum reserves the right to adjust pricing prior to final booking confirmation. Conversion rates, bank fees, and international processing costs are borne by the Client.

5. Force Majeure & Delays. Casa Khnum shall not be held responsible for delays or modifications in the completion schedule resulting from force majeure events, including but not limited to natural disasters, pandemics, governmental restrictions, labor shortages, or supply-chain disruptions. In such cases, Casa Khnum may adjust reservation windows or completion dates as reasonably necessary without liability.

6. Client Obligations. The Client agrees to provide accurate personal, contact, and payment information. Any misuse, fraudulent chargeback, or violation of these Terms may result in immediate cancellation of the Pre-Sale participation without refund. The Client also agrees to use Casa Khnum’s facilities responsibly and in accordance with its sustainability and ethical policies.

7. Refund & Cancellation. Refunds are only applicable under the conditions specified in the Refund & Cancellation Policy. After the 15-business-day refund period from the payment date, all Pre-Sale transactions become final and non-refundable. Requests must be submitted exclusively by email to info@casakhnum.com.

8. Intellectual Property. All designs, photographs, texts, concepts, and materials appearing on the Casa Khnum website are the exclusive property of Casa Khnum and are protected under international copyright laws. Any reproduction, distribution, or use of content without prior written authorization is strictly prohibited.

9. Limitation of Liability. Casa Khnum shall not be liable for indirect, incidental, or consequential damages arising from participation in the Pre-Sale or use of its website. In any case, Casa Khnum’s maximum liability shall not exceed the amount actually paid by the Client under the Pre-Sale program.

10. Communication & Notifications. All formal communications must be made via email to info@casakhnum.com. Notifications sent through other means (such as social media or instant messaging) will not be considered valid for contractual purposes.

11. Governing Law & Jurisdiction. These Terms & Conditions are governed by the laws of the United Mexican States. For any interpretation, dispute, or enforcement, the parties expressly submit to the competent courts of Mexico City, waiving any other jurisdiction that may correspond by reason of present or future domicile.

12. Acceptance. By completing a Pre-Sale purchase, the Client declares to have read, understood, and voluntarily accepted all provisions of these Terms & Conditions, including all associated policies (Privacy Policy, Refund & Cancellation Policy, and Payment & Security Policy).

13. Exclusions: No Flights or Transportation Included. This Pre-Sale package does not include flights, airport transfers, ground transportation, or any travel-related services. The Pre-Sale covers only the lodging and the amenities expressly included in the specific package purchased. Guests are fully responsible for arranging and covering all transportation to and from Casa Khnum, as well as any additional services not explicitly stated.
